Both sets of DPAs are *DUAL USE and may be used when the third party is an independent controller and/or data processor. 
Instructions:

1. STAND-ALONE, EXECUTABLE DPA: 
You need to fill in the blanks for party names and addresses. EACH PARTY MUST SIGN THE DPA.

2. DIRECT PDF LINK: 
NO FILL IN INFORMATION OR SIGNATURES REQUIRED. Add the correct entity LINK to a purchase order or agreement. 
For example, “The parties agree to the terms and conditions of the Data Processing Agreement, incorporated by reference and found Link.”

*DUAL USE
Use these templates for all local German service providers/ suppliers/ vendors who:
a. handle personal data as an independent controller (e.g., health insurance providers/brokers, pension providers, government agencies, lawyers, accountants, temporary labor providers); and/or 
b. process personal data as a data processor (e.g., cloud storage providers, permanent labor recruiters, payroll providers, training providers, consultants, software providers, job relocation providers).
